    i’m smart enough to not get pisss drunk around people i don’t know. if you are unconscious from being drunk however, that is a different story. if you can’t say no, hell yea that is rape.

    In order to give consent, people have to be sober, therefore, having sex with someone when she is drunk is rape. 25/m/it will not happen to me because I get consent before any act of sexual intercourse and don’t use alcohol when doing so.

    If one of the partners never actually says yes, then by law it’s rape, yes. I am a woman and this happened to me. I didn’t press charges because I know it wasn’t done in malice. I was just afraid to tell him that I wasn’t comfortable with it.

    it might not be the best choice but if someone chooses to get messed up beyond their ability to control i don’t think that is quite the same as rape and most drunks do give consent when they have sex as long as they haven’t passed out

    I am 19 and have had sex when I was drunk and I am a girl. It is my fault because I altered my mind and agreed. It is not his fault as he didn’t drug and alter my mind.

    I have a friend who blacked out and lost her virginity and says she was raped. Both people were drunk and she seemed fully consensual at the time. I specifically went to check on her to see if she was ok earlier and the night and she asked me to leave.

    This is a tough one. Some people believe that drunk people don’t know and or can’t control their actions. I would disagree. I have seen drunk people many times and they all seem very aware and in control of their actions. So if a woman who happens to be drunk says yes then no I do not think that is rape.

    Its too broad a question. If the woman is completely out of it and the guy knows she would never do it with him sober, then yes its rape. But otherwise then not really….. even if the girl is really drunk, if she consents then but regrets in the morning then its not rape.

    Im female. early 20’s and have had the second senario happen but not the first.

    When a guy has sex with a drunken woman, it IS rape, whether others try to twist it off as otherwise, whether others like it or not.

    Not sure what I believe here. It’s ridiculous to say a woman can’t willfully consent after having a drink. There is a line, but when and where it’s crossed is a question I can’t answer.

    When do people take responsibility for there actions. I am not talking forcing anyone here but that is pure nonsense. I know for a fact some women get drunk to have sex so if it doesn’t work out they can blame the drinking. So now you need to have a Breathalyzer when on a date. Well if you were drinking and didn’t want sex you should stay home and drink alone.

    If I were a guy, I wouldn’t take the chance. If she’s too wasted to give consent, she probably won’t remember even if she did, and that can lead to trouble down the line. It’s better to just sleep with women who are totally into it.

    I’ve been in the situation myself just out of college where I was in and out of being passed out and the guy I was on the date with was having sex with me. I remember waking up and he was on me and then waking up again at some point and he was still doing it.

    Was that rape? It probably was, but I felt somewhat responsible for letting myself get that drunk around someone I didn’t know well enough to trust. He, on the other hand, didn’t think anything was wrong with it because I ended up sneaking out of his house after I sobered up while he was asleep next to me and he asked me the next day at work (we worked together) “Hey, why’d you leave without saying goodbye?” I was pretty surprised considering what he’d done, but I never made a big deal out of it. I just warned other girls I worked with not to get drunk around him.

    The reality is, a normal, good guy doesn’t need to do this. They don’t need to have a warm, limp body to screw. They don’t need to try to get girls drunk so that they’ll be more likely to have sex with them.

    As long as the person doesn’t reject the other and isn’t unconscious then its not rape in my opinion. Ive had sex while drunk and my partner wasn’t drunk but I definitely wasn’t raped lol.

    A guy wouldn’t know how drunk a female is if she is participating in the lovemaking process, (ie.kissing,fondling,removing her clothes) as in all likelihood he is probably more inebriated. It’s a totally different scene if she is passing out, then I think you must help her get through that stage making sure she doesn’t barf up and choke, or get up and fall somehere getting hurt. I don’t know any girls that get that drunk, or any guys that would want to have sex with a alcohol corpse. On the other hand I’ve had on accasion more drinks than I should, went home with a girl, woke in the morning completely naked and been told how we had sex for hours yet I don’t remember anything,even how we got home. As for your question ” The law implies and considers a drunk woman is unable to reasonably to consent to having sex. This could also be said that she is unable to reasonably say no to sex.In fact if this is the case in law then a drunk woman is unable to reasonably consent to yes or no leaving her with no right of defense, and denying
    her a basic human assumption. I am a single male, 26 years old.

    I think that if the girl is fully conscious (whether her judgment is affected or not) it should not be considered rape.

    I’m male, and have never been in that situation. I wonder what people would say if the guy was drunk but the girl was sober. I also think that people do need to take responsibility for their actions. What are we going to start doing – requiring people to sign contracts stating they’re in a sober mental state before anything happens?
